Terms of Service
These terms apply when you use phomaapp.com, the Phoma desktop app and the Phoma cloud services (together, “Phoma”). By creating an account or using Phoma, you agree to them. If you don’t agree, please don’t use Phoma.
What Phoma is
Phoma is a Windows desktop app for controlling and automating Android phones: screen mirroring, a layout inspector, drag-and-drop flows that run on one phone or many, schedules and an AI agent. Its cloud services add your account, teams that share phones and flows, and a flow store.
Parts of Phoma are in beta. Features may change and some things may not work as expected. We work to keep the service available, but we don’t guarantee that it will be uninterrupted or error-free.
Your account
You need an account to use Phoma’s cloud services. Give us accurate information, keep your password safe, and don’t share your login outside your team. You are responsible for what happens under your account.
You must be at least 16 years old to use Phoma. If you use Phoma on behalf of an organization, you confirm that you are allowed to accept these terms for it.
Plans and payments
Everything that runs on your own computer and phones is free. Paid plans (Team and Business) are bought for a team: they let the owner invite people, share phones with them and keep shared flows, within the limits shown on the pricing page when you buy.
Plans are bought for 1, 3 or 12 months and paid in advance. They don’t renew automatically: when a period ends, your account returns to the Free plan unless you buy again. Buying the same plan again adds to the time left. Switching to another plan while one is active converts the remaining value of your current plan into time on the new one.
You pay the price shown at checkout, by bank transfer, card or crypto, in the currency shown there. We may change prices for future purchases; a change never affects a period you have already paid for.
When a plan ends, or a smaller plan has room for fewer people than your team, the team keeps everything it has and can still open and delete it, but can’t add anything new until it fits the plan again.
Refunds
If you were charged twice for the same order, charged the wrong amount, or paid for something we could not deliver, email us with the order code and we will refund or correct it.
Other refund requests are considered case by case. When a payment is refunded, the plan time or the store license it bought is removed from your account.
Your content and data
Your flows and other content belong to you. Flows you share with a team are stored on our servers so your teammates can use them; we use them only to provide Phoma, as described in our Privacy Policy.
You are responsible for what you put into Phoma and for the phones you connect, including having the right to control them and to use the apps and accounts on them.
Privacy PolicyAI features
The AI agent runs on AI you bring: an API key from a provider you choose, or your own ChatGPT or Claude subscription. AI is not included in any Phoma plan. What the agent sends goes from your computer to that provider, under that provider’s terms and pricing. AI output can be wrong: check what a flow does before you rely on it.
Responsible use
Phoma is built for legitimate automation and testing. You are responsible for complying with the terms of every app and service you automate, applicable law and your organization’s policies. You must not use Phoma to:
- break the law or infringe anyone else’s rights;
- gain unauthorized access to accounts, devices, systems or data;
- commit fraud or impersonate people or organizations;
- send spam or run harassing or deceptive campaigns;
- collect personal data without a lawful basis;
- distribute malware, or disrupt or overload Phoma or any other service;
- resell access to Phoma’s cloud services or work around plan limits.
Flow store
The flow store lets Phoma users sell flows to other users. Flows in the store are made by independent sellers, not by Phoma, and each seller is responsible for what they sell. We review every version before it goes on sale, but we don’t guarantee any flow.
When you buy a flow, you get a license to use it with your Phoma account. Don’t redistribute it: each download carries a signed watermark that identifies the account it was issued to. If a purchase is refunded, the license is revoked and the flow can no longer be downloaded.
Sellers receive the sale price minus the platform commission shown when they join. Earnings are held for a period before they can be withdrawn, are paid to the bank account the seller provides once they reach the minimum payout amount, and are reversed if the sale is refunded. We may reject or remove listings and suspend sellers that break these terms.
Suspension and termination
You can stop using Phoma at any time, and ask us by email to delete your account.
We may suspend or close accounts that break these terms or put Phoma or other users at risk. Where we can, we will tell you why and give you a chance to fix it. If we close your account because you broke these terms, the remaining time on your plan is not refunded.
Disclaimers and liability
Phoma is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose.
To the extent the law allows, we are not liable for indirect or consequential losses, or for lost data, profits or accounts, including accounts on other apps or services that restrict or suspend you because of automation. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
Governing law
These terms are governed by the laws of Vietnam. Nothing in them limits rights you have under consumer protection laws that cannot be waived.
Changes to these terms
We may update these terms. When we do, we change the date at the top; for significant changes we will also let you know on the website or in the app. If you keep using Phoma after a change takes effect, you accept the updated terms.
